Agreement to Terms

By downloading, installing, or using the PortionPal mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

Eligibility

Age Requirement

• You must be at least 15 years of age to use PortionPal
• The App is not intended for children under 15
• By using the App, you represent that you are 15 years of age or older
• If we discover that a user is under 15, we will terminate their access immediately

Capacity to Accept

By using the App, you confirm that you have the legal capacity to enter into these Terms.

Account and Registration

No Account Required

• PortionPal does not require account creation or sign-up
• No username, password, or personal identification is needed
• You can start using the App immediately after download

Not Medical Advice

Health Conditions

If you have any pre-existing medical conditions, particularly diabetes, cardiovascular disease, or metabolic disorders, consult your healthcare provider before using this App.

Subscription Terms

Free Trial

• New users receive a 14-day free trial with full access to all features
• No credit card required to start the trial
• Trial automatically converts to a paid subscription unless cancelled

Subscription Plans

After the free trial, you may subscribe to:

• Weekly subscription
• Monthly subscription
• Yearly subscription

Billing and Payments

• All subscriptions are processed through Apple's In-App Purchase system
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Payment will be charged to your Apple ID account at confirmation of purchase
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Refunds

• All purchases and refunds are handled by Apple
• We (the developer) do not have access to payment information or ability to process refunds
• To request a refund, contact Apple Support directly
• Refund policies are subject to Apple's terms and conditions
• Generally, refunds may be requested within a certain timeframe as per Apple's policy

Subscription Changes

• We reserve the right to modify subscription prices with 30 days' notice
• Price changes will not affect existing subscriptions until renewal
• You will be notified of price changes through the App or email

Prohibited Uses

You agree NOT to use PortionPal for any of the following:

Illegal Activities

• Any illegal purpose or in violation of any local, state, national, or international law
• Violating or infringing the rights of others

Harmful Activities

• Harassing, threatening, intimidating, or harming another person
• Blackmailing or extorting others
• Impersonating any person or entity

System Abuse

• Attempting to reverse engineer, decompile, or disassemble the App
• Introducing viruses, malware, or other malicious code
• Interfering with or disrupting the App's functionality
• Attempting to gain unauthorized access to any systems or networks

Misuse of Data

• Sharing or distributing data obtained from the App inappropriately
• Using the App to collect information about others without consent

Consequences of Violation

If you violate these Terms:

• We may immediately terminate your access to the App
• We may report illegal activities to law enforcement
• You may be held legally and financially responsible for damages
• No refund will be provided for terminated accounts

User Data and Privacy

Data Storage

• All personal health data is stored locally on your device
• Data is automatically backed up to your iCloud account (if enabled)
• The developer does not have access to your personal health data
• Your data includes: glucose readings, food logs, weight, steps, and other health metrics

Data Security

• You are responsible for maintaining the security of your device
• Use device security features (passcode, Face ID, Touch ID) to protect your data
• Be cautious when using the App on shared or public devices

Analytics

• We collect anonymous analytics to improve the App
• Analytics data is not linked to you personally

Intellectual Property

Ownership

• PortionPal and all its content, features, and functionality are owned by the developer
• This includes but is not limited to: software code, design, graphics, text, and trademarks
• You are granted a limited, non-exclusive, non-transferable license to use the App

Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Remove or alter any copyright, trademark, or proprietary notices

Third-Party Services

Apple Health

• Integration with Apple Health requires your permission
• Apple Health is governed by Apple's terms and conditions
• You can revoke Health access at any time in iOS Settings

Firebase Analytics

• We use Firebase for anonymous analytics
• Firebase is subject to Google's privacy policy and terms

Apple In-App Purchase

• Subscriptions are governed by Apple's terms and conditions
• All payment disputes must be handled through Apple

Disclaimers and Limitations

App Availability

• We strive to keep the App available 24/7 but do not guarantee uninterrupted access
• The App may be unavailable due to maintenance, updates, or technical issues
• We are not liable for any unavailability or downtime

"As Is" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of data

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, revenue, data, or use
• We are not liable for any health outcomes or medical decisions made based on the App
• Our total liability shall not exceed the amount you paid for the App in the past 12 months

Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

Updates and Modifications

App Updates

• We may release updates to improve functionality, fix bugs, or add features
• Updates may be required for continued use of the App
• You are responsible for downloading updates

Terms Updates

• We reserve the right to modify these Terms at any time
• Changes will be effective immediately upon posting in the App
• Continued use of the App after changes constitutes acceptance of the new Terms
• Significant changes will be communicated via in-app notification

Termination

By You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Cancelling your subscription in Apple ID Account Settings

By Us

We may terminate or suspend your access immediately if:

• You violate these Terms
• You are under 15 years of age
• Required by law or legal obligation

Effect of Termination

• Your right to use the App will cease immediately
• Locally stored data will remain on your device until you delete the App
• Subscription fees are non-refundable except as required by law
• Provisions of these Terms that should survive termination will remain in effect

Dispute Resolution

Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Abbottabad, Pakistan.

Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer regarding the App and supersede all prior agreements and understandings.
